Terms of Service for Fresh & Co. (P SPEC PTY LIMITED)

Welcome to Freshnco.au ("we", "us", "our"). These Terms and Conditions ("Terms") govern your access to and use of our website freshnco.au and the purchase of our products, including Laundry Detergent Sheets in scents like Berry Party and Fresh Linen ("Products").

By accessing our site, placing an order, or using our services, you agree to these Terms. If you do not agree, please do not use our site or purchase from us.

1. Who are we

2. Products and Orders

  • All Products are described on the site to the best of our ability. Images are for illustration; actual colours/scents may vary slightly.
  • We reserve the right to refuse or cancel any order (e.g., due to pricing errors, stock issues, or suspected fraud). We'll notify you and refund if payment was taken.
  • Orders are offers to purchase — a contract forms only when we send order confirmation.

3. Pricing and Payment

  • All prices include GST and are in AUD.
  • We accept [list methods: e.g., credit/debit cards via Stripe/PayPal].
  • You must provide accurate payment details. We are not liable for errors in your info.

4. Shipping and Delivery

  • We ship Australia-wide (free shipping on bundles/subscriptions where stated).
  • Delivery estimates: [e.g., 3–7 business days metro; 7–14 regional]. These are estimates only — delays can occur (weather, carriers, etc.).
  • Risk and title pass to you upon dispatch.
  • Check your order on arrival. Report issues within 48 hours.

5. Australian Consumer Law Guarantees (Important – Non-Excludable) Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Full details: See Schedule 2 of the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts, or modifies your rights under the ACL.

6. Returns, Refunds, and Cancellations

  • Change of mind: We accept returns for unused/unopened Products within 30 days (you pay return shipping). Refund issued minus original shipping costs.
  • Faulty/Damaged/Wrong Item: Contact us within 30 days with photos. We'll provide prepaid return label (if major failure) or remedy per ACL (repair/replace/refund).
  • Cancellations: Before dispatch — possible (contact us ASAP). After dispatch — treated as returns. See our separate Refund Policy for full details (link on site).

7. Subscriptions

  • Subscriptions auto-renew at the chosen frequency/price (discounts apply).
  • Cancel anytime via your account or email us — effective next billing cycle.
  • We may adjust subscription terms with notice.

8. Intellectual Property All content (text, images, logos, designs) is owned by us or licensed. You may not copy, reproduce, or use without permission.

9. Limitation of Liability To the maximum extent permitted by law:

  • We are not liable for indirect/consequential losses (e.g., lost profits).
  • Our total liability is limited to the price paid for the Product. This does not limit rights under ACL.

10. Privacy We handle your data per our Privacy Policy (separate page). By using the site, you consent to collection/use as described.

11. Governing Law These Terms are governed by the laws of [Your State, e.g., New South Wales], Australia. Disputes resolved in courts of that jurisdiction.

12. Changes to Terms We may update these Terms. Continued use = acceptance. Check back periodically.
